LIABILITY STATEMENT

 

By signing this Rental Application and Agreement, the Renter agrees to assume the responsibility and legal liability for the above described event, and to abide by all the Conditions, Rules and Regulations included with this Application /Agreement upon acceptance of this Application / Agreement by The Fountain Arts Center, Inc.  Additionally, the Renter agrees to indemnify, defend, and hold harmless The Fountain Arts Center, Inc., and Arbor Development, and Belmont Apartments LLC, from any and all claims for bodily injury or property damages that may arise out of or in connection with this Agreement and  use of the subject premises.  The Renter has also reviewed, completed, and signed the attached Information and Questionnaire form.

PAYMENTS

All checks should be made payable to The Fountain Arts Center, Inc.

Deposit of 30% is to be submitted with each Application/Agreement.  The balance of the facility rental fee is to be paid no later than ten (10) days prior to the event date.

 

CANCELLATIONS

A refund of the entire amount deposited will be given if a written cancellation is received thirty (30) days prior to the event.

 

ITEMS INCLUDED IN RENTAL FEE

Rental fee includes: round and/or rectangular tables, chairs, podium, and microphone.

 

ITEMS NOT INCLUDED IN RENTAL FEE

Tablecloths: Renter supplies tablecloths, or rents linens from The Fountain Arts Center, Inc.  You may set up the hall and tables two hours before the start time of your event, with prior approval, at no extra charge.

 

RULES AND REGULATIONS

1.  You must clean off all tables before leaving at your scheduled time, and empty trash barrels into dumpster provided.

 

2.  The kitchen (if use is part of rental agreement) must be cleaned, all personal items removed, and the floor must be swept.

 

3.  ABSOLUTELY NO HANDLING OR REMOVAL OF ANY ARTWORK ON THE WALLS, without express written consent and/or assistance of Fountain Arts Center personnel.

Decorating must be approved by Fountain Arts Center.  ONLY painters tape, no tacks or nails may be used on the walls.

 

4.  No beer kegs of any kind are allowed (bottled and canned beer ONLY).

 

5.  Candles may be used with permission if surrounded by glass holder or globe.

 

6.  No propane gas tanks may be used without prior written approval.

 

7.  The Renter hereby accepts the premises in the condition in which they are at the beginning of this lease and agrees to maintain said premises in the same condition, order, and repair in which they are at the commencement of said term excepting only reasonable wear and tear arising from  the use thereof under this agreement, and the Renter shall be liable to The Fountain Arts Center, Inc., and forever hold harmless The Fountain Arts Center, Inc., and Arbor Development, Inc., and Belmont Apartments Associates, LLC, from any and all such damage or loss occasioned to the premises caused by the acts of negligence of the renter or any persons in the employ or under the control of the lessee.

 

8.  The lessee assumes all risk for the scheduled event and shall be solely responsible and answerable for all damages, accidents, and injuries to persons and to personal property and hereby agrees to indemnify and keep harmless The Fountain Arts Center, Inc., Arbor Development, Inc., and Belmont Apartments Associates, LLC., and their representatives from any claims, suits, losses, damage, or injury to person or property of any kind and nature whether direct or indirect arising out of the operation of this permit or the carelessness, negligence, or improper conduct of the lessee or any servant, agent, or employee.  It is expressly understood and agreed that no real or personal property is leased to the lessee.

 

9.  The Renter shall indemnify and hold The Fountain Arts Center, Inc., Arbor Development, Inc., and Belmont Apartments Associates, LLC harmless from any and all claims liability, losses, and causes of actions which may arise out of the operation of the Renter’s function under the lease agreement.  The Renter shall pay all claims and losses of any nature whatsoever in connection therewith, and shall defend all service in the name of The Fountain Arts Center, Inc., Arbor Development, and Belmont Apartments Associates, LLC when applicable, and shall pay all costs and judgments which may issue thereon.

 

10.  The room must be vacated by the agreed upon ending time of the event (i.e. if the room is booked from 6:00 PM until 11:00 PM, all persons must be out of the room by 11:00 PM). 

 

11.  Signed Application and Agreement, deposit and Rental Questionnaire must be received no less than thirty (30) days before the event occurs.

 

12.  Usage must be limited to the activities listed in the Application or attachments at The Fountain Arts Center’s discretion.

 

13.  Number of participants expected must be stated and adhered to.

 

14.  Additional charges may be made if equipment or maintenance services are required.

 

15.  Use will be limited to the specific areas stipulated.

 

16.  The Fountain Arts Center will provide an attendant on the premises prior to set-up, during function, and for locking and securing the facility after the function.

 

17.  Proper clothing is required.

 

18.  The Fountain Arts Center reserves the right to cancel for not abiding by regulations, misconduct, or another action detrimental to participants of The Fountain Arts Center, Inc.,  Arbor Development, Inc., or Belmont Apartments Associates, LLC.

 

19.  Renter agrees to furnish any other information requested by The Fountain Arts Center, Inc.

 

20.  If determined that any of the previous regulations are not applicable to a particular function, it will be at the discretion of the responsible Fountain Arts Center representative to waive said regulations.

 

21.  If having a party catered or renting any equipment, it must be removed immediately after the event.

 

22.  The Fountain Arts Center will not be responsible for any lost or damaged goods.

 

23.  There is absolutely no smoking in the building.

 

24.  There can be no cash bar, unless you have a caterer for your event and their liquor permit expressly permits a cash bar.
